Motion To Dismiss Denied

11:18am. Most members of our gallery are still out in the hallway. However, our attorneys are present and Wittman makes a motion to dismiss the murder charge and all robbery charges except those against Gary and Stephen Lennon.

Wittman's basis: 1) Healy was in custody when Officer Joseph Corr was shot and killed. 2) Jewelry store employees do not own the merchandise.

Judge Michael Dwyer did not grant the dismissal. The case continues as expected.

How could the defense ask for a motion to dismiss the robbery charges for the robbery of the employees, wasn't the fact that these employees were held at gunpoint and threatened worth the robbery charge. I think that fact that they were threatened and the one thought she was going to be shot and killed that they should charge him with even more.

Defense attorneys crack me up...I think it may have finally sunk in that Healy is not going anywhere but to his cozy little cell so she's getting desperate and pulling all kinds of crap out of her azz to 'save him". GIVE ME A BREAK!

She is doing her job...Does anyone really think that this is what she wants to do? How do you think this woman feels every night when she goes to sleep she is represeting a guy that ripped apart our "safe" town and shook this communtity up. She did not ask for this job it was given to her and she is just trying to do it...I know and everyone else does that he is not going to get off on these charges, but like the rest of us she has a job to do whether or not she thinks it's right...Everyone needs to put yourself in her shoes for a minute and think what is going on in her head....

I can't even believe that Wittman made that motion. All I can say, she needs to go back to law school and learn the laws of NYS. Also, how would she feel if it were her that was a worker in that store and all this happened to her or even a love one. Bet, there would be no motion like that.

I agree that she is only doing her job, but she also has to do the right thing ethically.

Well, I understand completley that she is only doing her job and it was given to her (as opposed to her choosing this case)...however, how she feels every night is a moot point. When she went to law school she CHOSE to defend murderers, rapists, etc.
The mindset of *most* defense attorneys is that even when faced with a mountain of evidence that proves their client is guilty, they can somehow magically sway the jury to forget all of that and find their client not guilty. Sometimes it works, sometimes it doesn't. It's not going to work here...

where is her head and what is she thinking? All I can say is I hope she can go away after this trial with a clear mind that justice was served and the Corr family finally found closure. She is grasping at straws or whatever right know cause it's done to the final hours. And I can't wait to hear the verdict and see her face when the Judge says "GUILTY" on all charges!!! Also I believe that the defense chose this case she wasnt appointed he is paying......She loves this

Perhaps she does know whats she's doing...look at it this way..maybe she is acting SO ridiculous so that she does not get him aquited???? Maybe she knows deep down that he is guilty and wants him to go to jail. Dumb like a fox maybe?

This attorney is noted for taking scum bags on for a defense. Not only is the clients low to begin with but Wittmans tactics are low and unethical at times prior to going to trial. What is funny about Wittmann is that the same scum bags that she represents are the same ones slamming her and defaming her behind her back. Becky, you get back what you respresent, DIRT! Oh and by the way this is the same attorney who is taking to trial another piece of fecal matter that raped an eldery woman in Rome City Hospital. Wait until you see Becky's lowlife defense on that case. Beck, dont always believe what the scum bag clients tell you because you never know what they are saying about you.

I am a realist!
Fact 1...a conviction is eminent
Fact2...reversal on error due to the admissability of the tainted evidence and other important appealable points that the defense attorney has preserved.
fact 3....conviction is overturned

Does anyone support this? Probably not, but when it happens, sloppy police work in the gathering of evidence will rest on the shoulders of law enforcement.

if anyone thinks Wittman doesn't enjoy this case,you are crazy, her boyfriend is a scumbag drug dealer who is on parole for sale of a controled substance, one of her good friends was ex-discraced attorney Bob Moran who was involed with the use and sale of methamphetamine and is now a resident of the NYS Correctional Facility. Wittman is no better than the people that she represents and someday hopefully sooner than later she will be sitting in the defendants chair herself.

what the hell kind of analogy is that? Witman will be remembered for her stupidity!! No wonder she gets the bottom of the pot to defend.

Also, Whitman is NOT a public defender. She is charging Healy for this - and he deserves her representation. The compensation most likely comes from the sale of Rolex watches!
